These Terms of Service (the "Terms") govern your use of ColorFitapp (the "Service"), an AI-powered personal color analysis service operated by us ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Scope

These Terms apply to all access to and use of the Service. Any guidelines, rules, or notices we post on the Service form part of these Terms.

2. Description of the Service

The Service analyzes a face photo you upload using AI and returns an estimated personal color result (one of four seasonal types), best/worst color palettes, and AI-generated outfit images. The output is provided for entertainment and informational purposes only and is not medical, dermatological, psychological, fashion, or other professional advice.

3. Eligibility

The Service is intended for users 18 years of age or older. Users between 13 and 17 may use the Service only with the consent of a parent or legal guardian. The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

4. Accounts and email

No account is required to use the Service. If you choose to provide your email address, we use it to deliver your result, send reminders, and notify you about important Service updates. You can unsubscribe at any time via the link at the bottom of any email or by contacting us.

5. Photos you upload

You may upload only photos of yourself. If a third party appears in any photo you submit, you represent and warrant that you have obtained their explicit, informed consent. Uploading photos that infringe portrait, privacy, copyright, or other rights of any person is strictly prohibited.

6. License you grant to us

You grant us a worldwide, royalty-free, non-exclusive, limited license to host, store, process, transmit, and analyze the photos and other content you submit, solely as necessary to provide the Service to you (including analysis, AI processing, generation of output, and limited internal quality review). This license terminates automatically when the underlying data is deleted under our retention schedule (see Privacy Policy).

7. AI-generated output and disclosure

All result text, palettes, and images output by the Service ("Output") are produced by generative AI. The Output does not perfectly represent your appearance or attributes and may contain inaccuracies, biases, or hallucinations. AI-generated images may include AI-disclosure markings, ColorFitapp branding, or watermarks; you may not remove or alter them.

8. License to use the Output

Subject to these Terms, we grant you a personal, non-commercial, non-exclusive, non-transferable license to download, save, and share Output that depicts you on social media for personal expression. Commercial use, paid transfer to third parties, resale, inclusion in AI training datasets, or redistribution with our markings removed is prohibited.

9. Acceptable use

You agree not to: (a) violate any applicable law or third-party right; (b) harass, defame, discriminate against, or impersonate any person; (c) upload nudity or sexual, violent, or otherwise unlawful content; (d) upload images of children under 13; (e) reverse engineer, scrape, or apply automation that places undue load on the Service; (f) use the Service to train or build competing AI models; (g) remove our markings or watermarks; or (h) engage in any other conduct we reasonably deem inappropriate.

10. Beta status, changes, and discontinuation

The Service is currently a beta. Features, UI, and availability may change at any time, and the Service may be temporarily suspended for maintenance or permanently discontinued without prior notice. We will use reasonable efforts to notify users of material changes but do not guarantee notice.

11. Disclaimer of warranties

THE SERVICE AND THE OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION. ANY DECISIONS YOU MAKE BASED ON THE OUTPUT ARE YOUR OWN RESPONSIBILITY.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM (WHICH, FOR A FREE SERVICE, IS USD 0).

13. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms or your violation of any third-party right.

14. Suspension and termination

We may suspend or terminate your access to the Service, or delete data associated with your use, at any time without prior notice if we reasonably believe you have violated these Terms or applicable law.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced on the Service and, where reasonable, via the email address you provided. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Governing law and dispute resolution

These Terms are governed by the laws of Japan, without regard to conflict-of-law principles. Disputes will be resolved in the Tokyo District Court (Tokyo, Japan) as the court of first instance with exclusive jurisdiction. Nothing in this section deprives you of mandatory consumer protections available under the laws of your country of residence.
